Terms of Service.

By accessing or using promogranade.com (the "site"), you agree to these Terms of Service. If you do not agree, please do not use the site.

The site is intended for a business audience. By using it you confirm that you are legally able to form a binding contract under the laws that apply to you, and that you are using the site for legitimate business purposes.

• If you use the site on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.
• If you are not able to form a contract or are not so authorised, you must not use the site.

These terms govern your use of the website only — browsing our pages, reading our content, and using the contact form, careers form, or the "Promo" chatbot.

Paid work is different. Any project we deliver (web development, custom applications, AI agents / systems, SEO / GEO / AEO, social media marketing, Meta and Google ads, workflow automation) is governed by a separate signed proposal, statement of work, or services agreement.

Where a separate signed agreement covers a paid engagement, that agreement prevails over these terms for that engagement. Nothing on this website is itself a binding offer, quote, or contract for services.

A few terms used throughout, kept light:

• "Site" — the website at promogranade.com and its pages, features, and forms.
• "Content" — text, design, graphics, code, logos, and other material made available on the site.
• "You" — the person or organisation accessing or using the site.
• "Submission" — any information you send us through the site, including via the contact form, the careers form (including an uploaded résumé), or the chatbot.
• "Personal data" — information relating to an identified or identifiable individual, as defined under applicable data protection law and our Privacy Policy.
• "Privacy Policy" — our privacy notice at promogranade.com/privacy, which forms part of these terms by reference.

You may browse the site and use its features for their intended purpose: learning about our work, contacting us, applying for a role, and asking the chatbot questions.

When you send us a submission, you confirm that the information is accurate and current, and that you have the right to share it.

If a submission includes personal data about another person — for example, a reference or contact you name in a résumé or message — you confirm you have the right to share that data with us for the relevant purpose.

You grant us permission to use your submissions to respond to you, evaluate enquiries, and assess job applications. How we handle this data, the third parties involved, and your rights are described in our Privacy Policy.

All content on the site — including its design, layout, code, text, graphics, the Promogranade name, and the Promogranade logo — is owned by Promogranade or its licensors and is protected by intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to view and use the site for your personal or internal business evaluation. No other rights are granted.

• You may not copy, reproduce, scrape, republish, distribute, or commercially reuse any content without our prior written permission.
• You may not remove or alter any proprietary notices.
• The Promogranade name, logo, and any related marks are trademarks of Promogranade. Use of them without written permission is not allowed.
• We reserve all rights not expressly granted to you.

The "Promo" assistant answers common questions from a built-in rule list and, for open-ended questions, may use Anthropic's API (Claude) to generate a reply. It is provided for general information and convenience only.

Chatbot responses may be inaccurate, incomplete, or out of date. They are not professional, legal, financial, or technical advice, and they are not a binding quote, offer, or commitment by Promogranade.

The chatbot does not make automated decisions that produce legal effects, or similarly significant effects, about you. It is an informational tool, not a decision-maker.

• Do not enter confidential, sensitive, or third-party personal data into the chatbot. Open-ended messages are transmitted to Anthropic and processed under Anthropic's own terms; see our Privacy Policy for detail.
• Do not rely on the chatbot for important decisions without confirming with our team.
• Anything that matters — scope, timeline, price, or commitments — should be confirmed with us directly at hello@promogranade.com.

Our blog, service pages, and other site content are general information about what we do. They are not a binding quote, guarantee, warranty of results, or professional advice.

The scope, timeline, and price of any work are confirmed only in a separate written proposal or signed agreement. Nothing on the site creates an obligation for us to provide services on any particular terms.

The site relies on, and links to, third-party services. We do not control these services and are not responsible for them. Your use of them is governed by their own terms and privacy policies. Some of these providers process data internationally; see Section 5.2 and our Privacy Policy.

• Outbound links to WhatsApp and Instagram (operated by Meta) and to LinkedIn.
• Google Workspace (Google LLC), where contact-form data rests, and the company mailbox hosted by Google to which careers submissions are delivered.
• FormSubmit (formsubmit.co), which relays careers-form submissions, including résumé files.
• Anthropic's API (Claude), which may process open-ended chatbot messages under Anthropic's own terms.
• Vercel (Vercel Inc.), our hosting provider, which processes standard server and request logs (such as IP address, user agent, and timestamps) to serve, secure, and debug the site, as described in our Privacy Policy.
• We are not liable for the availability, content, or practices of any third-party service, and a link does not imply endorsement.

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, about the site.

We do not warrant that the site will be uninterrupted, timely, secure, or error-free, or that any content is accurate, complete, or current. Nothing in this section limits rights that cannot be excluded under applicable law.

Website access is provided free of charge. To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site.

To the fullest extent permitted by applicable law, our total aggregate liability to you for any and all claims relating to the site is limited to a reasonable sum equivalent to INR 50,000. We recognise that some jurisdictions do not allow certain exclusions or limitations of liability, in which case the limitations in this section may not apply to you in whole or in part.

• Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or any non-excludable consumer or statutory rights you may have.

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Promogranade, its founder, and its team from any third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your misuse of the site, your material breach of these terms, or your breach of any applicable law or the rights of a third party.

This indemnity does not apply to the extent a claim arises from Promogranade's own negligence, breach, or wrongful act.

Your use of the site is also governed by our Privacy Policy, available at promogranade.com/privacy, which explains what personal data we collect, how we use it, the third parties and international transfers involved, and your rights. Please read it alongside these terms.

We may restrict, suspend, or terminate your access to the site at any time, without notice, if we reasonably believe you have misused it, breached these terms, or acted unlawfully.

Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — continue to apply after your access ends.

We may update these terms from time to time to reflect changes to the site, our practices, or the law. The current version will always be posted on this page with its update date.

Your continued use of the site after a change takes effect means you accept the updated terms.

These terms are governed by the laws of India. Subject to any non-excludable rights you have under your local law, the courts of competent jurisdiction in India will have non-exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of the site.

If you are a consumer or data principal resident in the EEA, the UK, or another jurisdiction with mandatory local protections, nothing in this section deprives you of the right to bring proceedings in, or rely on the mandatory forum and consumer or data-protection rules of, your place of residence.

If any provision of these terms is found unenforceable, the rest remain in full effect.

These terms (together with the Privacy Policy and any separate signed agreement for paid work) are the entire agreement between you and us regarding your use of the site.

Our failure to enforce a provision is not a waiver of it. You may not assign or transfer your rights under these terms without our consent; we may assign ours in connection with a reorganisation or transfer of our business.

We are not liable for any failure or delay in making the site available where it is caused by events beyond our reasonable control, including outages of hosting or third-party services, network failures, acts of God, or government action.
